She smashed my left ankle to bits with the result that I’ve had two operations (so far). Her insurance is taking care of the claim for my injuries and rehabilitation, etc., but I am not happy with the Police as they have told me they are not prosecuting her because she is young and also got hurt. My view is they should bring back National Service and send her off for some discipline.
Equally, I do recognise that I am pretty angry about the whole thing. Nonetheless, what can I do to help her get prosecuted?
Answer
The Police’s job is to gather the evidence. The Crown Prosecution Service (CPS) then makes a decision whether to prosecute. The CPS should look at The Code for Crown Prosecutors.
There are two main considerations:
1. Is there enough evidence against the defendant?
2. Is it in the public interest for the CPS to bring the case to court?
If you want the driver considered for prosecution, I would read the guide and then write to the Police/CPS with your reasons and ask for the matter to be reviewed with a view to prosecution and go from there.
I see no reason why this woman should not be prosecuted for driving without due care and attention. Being young and/or injured is no reason at all. Whilst you shouldn’t have to, I advise you persevere.
