The purpose of these guides is to provide background information on the overall system and details of how to bring a motorcycle accident compensation claim, including a personal injury claim. They are in no way intended as an alternative to obtaining specialist motorcycle legal advice.
However, it is our experience that people are often confused about what a compensation claim entails. The following guides should help you in that respect. Please remember that you are always free to contact us to discuss your case and if it goes no further there is no charge.
Since the introduction of LASPO in 2013, the law was amended to:
- Include a 10% uplift on the injury aspect of your case; and
- To allow a maximum contribution of 25% in respect of your damages claim, to be paid towards your own legal costs.
If you instruct us, the solicitor with conduct of your claim will give you a more accurate estimate of the likely value of your claim. They will also explain the potential deduction from damages which cannot be more than 25% of your damages claim.
The actual sum we may deduct varies from case to case. We have found, on the lower value claims it is likely we will be deducting the full 25%. On higher value claims, we do not always deduct 25%. This is simply because catastrophic injury cases are of such high value, the legal bill isn’t always so high as to represent a 25% deduction of your damages award. We do pride ourselves on providing value for money for our clients; especially as you are instructing real specialists in this field of work.
We provide this guide to assist you in making an informed decision under the SRA’s Transparency Rules. You can contact us for full details of our hourly rates.
